BINDING CONTRACT
2.1 EXSCI provides the Services to the Pupil subject to these Terms and Conditions. By registering and accepting them, you agree, for yourself and the Pupil, to be bound by them.
2.2 A binding contract is formed when EXSCI sends written confirmation that the Pupil has been accepted. For an online booking, that confirmation is the booking confirmation we send you, including by email. Reaching the payment page, or paying, does not form the contract before that confirmation is issued.
BOOKING
3.1 Each application for a Class, Course, Camp, Term Programme or Individual Lesson is accepted at EXSCI's discretion.
3.2 The Pupil is not accepted until EXSCI has provided that written confirmation.
INTELLECTUAL PROPERTY RIGHTS
4.1 EXSCI retains ownership of the intellectual property rights in EXSCI Materials.
4.2 You and the Pupil may keep copies of EXSCI Materials only for personal educational use, such as homework or class notes.
4.3 The content of each Class, Course, Camp or Individual Lesson is protected by copyright and may not be redistributed.
INDIVIDUAL LESSONS AND TERM PROGRAMMES
5.1 Term Programmes. Small Group Classes may be booked as a Term Programme for a specified term or part of a term. The scheduled dates and total fee are shown at the time of booking. Where a Pupil joins after the beginning of a term, the fee is normally calculated from the scheduled classes remaining in that term. Enrolment in one term does not enrol the Pupil in a later term unless that is stated at booking.
5.2 Individual Lessons. Individual Lesson packages contain the number of lessons shown at booking and may be scheduled with the tutor, subject to availability. A 6-lesson package must be used within 3 months of purchase. A 12-lesson package must be used within 6 months of purchase. A single Individual Lesson must normally be scheduled within 2 weeks of purchase.
5.3 Rescheduling Individual Lessons. An Individual Lesson may be rescheduled without loss of payment where you give at least 8 hours' notice In Writing. Where less than 8 hours' notice is given, the lesson may be treated as having taken place and remain payable, unless EXSCI agrees otherwise.
5.4 Missed Small Group Classes.Small Group Classes take place at the scheduled time for the group. If a Pupil cannot attend, the class is not normally refunded or individually rescheduled, because the class still runs and the place has been reserved. Any recording or alternative material offered after a missed class is provided at EXSCI's discretion, unless it is expressly included in the programme.
5.5 Cancellations by EXSCI. If EXSCI is responsible for a scheduled lesson or class not taking place, EXSCI will offer an appropriate alternative, such as rescheduling the session, or a credit or refund where rescheduling is not reasonably practicable.
PAYMENT OF FEES
6.1 Fees are payable in advance according to the payment schedule shown at booking. A family booking may include several children and programmes. Term Programmes, Individual Lesson packages and monthly memberships keep their own payment schedules.
6.2 If a payment becomes overdue, EXSCI may suspend future Services until the outstanding amount has been paid. EXSCI may seek to recover reasonable costs arising from overdue payments where permitted by law.
FAMILY PRICING
6.3 When two or more children from the same family have overlapping paid programmes, each additional child receives 12.5% off their eligible tuition. The highest-priced child's tuition remains at the standard price. The same percentage applies to the second, third and every further eligible child.
6.4 Children may attend different Small Group Classes, Individual Lesson programmes or Open Classes memberships. Each child is placed according to their level. Free trials, standalone lessons and camps do not qualify for this ongoing programme offer.
6.5 We compare standard tuition costs over the same period to identify the highest-priced child. Programme fees are divided by their agreed duration and costs for several programmes belonging to one child are combined. A larger upfront payment does not by itself make a programme the highest-priced. Where costs are equal, one child pays the standard price and the other eligible children receive the discount.
6.6 Individual programmes must have an agreed duration, shown before payment. Monthly memberships are compared over their paid membership period. The discount is calculated automatically for eligible family bookings, with the standard fee, saving and amount payable shown in the payment summary. Fees are rounded to the nearest penny.
6.7 The discount applies only during the overlapping paid programme period. Where programmes overlap for part of a booking, the saving is calculated proportionately for that part. Children joining later can qualify for their remaining eligible tuition.
6.8 Family eligibility is based on distinct children in the same family booking or verified family account. Booking several programmes for one child does not create a sibling discount. Add each child once and select them again when booking another programme for that child.
6.9 Purchased term programmes and individual packages retain the price agreed at payment. Changes to family enrolments affect future bookings and membership renewals. Already purchased tuition is not repriced solely because another child joins or leaves. A level check or unpaid reservation does not count as a paid programme.
COMMUNICATION WITH EXSCI
7.1 In Writing includes email to hello@exactscience.co, a posted letter sent by recorded delivery, or a message from an official EXSCI account on WhatsApp or Telegram.
7.2 Please tell us about a complaint or concern In Writing as soon as it arises. Email hello@exactscience.co.
ONLINE LEARNING
8.1 Online Classes are normally conducted using Zoom or another platform EXSCI specifies. Pupils should have a stable internet connection and suitable audio equipment. Use of a camera is normally expected where it helps the Pupil take part, subject to any reasonable accessibility, safeguarding or technical consideration.
8.2 EXSCI is not responsible for disruptions caused by your equipment or internet connection. This does not exclude liability that the law does not allow us to exclude.
COPYRIGHT AND CONTENT USE
9.1 EXSCI Materials remain the intellectual property of EXSCI or its licensors and are supplied for the Pupil's personal educational use.
9.2 EXSCI Materials may not be reproduced, published, sold, redistributed or made publicly available without permission, except where the law allows it.
THIRD-PARTY MATERIALS
10.1 Some educational materials may include or refer to content created by third parties, including mathematics competitions, examination organisations, publishers and other educational bodies.
10.2 Ownership of third-party materials remains with the relevant rights holders. EXSCI does not claim ownership of those materials.
10.3 Where third-party materials are used, they are used subject to the applicable licences, permissions or other rights available under the law.
HEALTH, ACCESSIBILITY AND SUPPORT NEEDS
11.1 Please tell EXSCI about any health, accessibility, learning or support needs that are reasonably relevant to the Pupil's safe and effective participation.
11.2 EXSCI will consider reasonable adjustments where appropriate. Information provided for this purpose is handled in accordance with the Privacy Policy and applicable data protection law.
11.3 Parents and guardians are responsible for keeping emergency contact information up to date.
CANCELLATION AND WITHDRAWAL
There are two different 14-day rights. Clause 12.2 is a statutory right to cancel an eligible distance contract within 14 days of entering into it, without giving a reason. Clause 12.3 is EXSCI's own rule for leaving a Term Programme later, which needs 14 days' notice In Writing. One does not replace the other.
12.1 Termination by EXSCI. EXSCI may terminate or suspend Services where fees remain unpaid, where there has been a serious breach of these Terms and Conditions, or where continuing would not reasonably be appropriate, including for safeguarding reasons. Where EXSCI ends a programme for a reason that is not attributable to you or the Pupil, fees paid for Services that will not be provided will be refunded. Nothing in this clause limits any statutory rights.
12.2 Statutory cancellation right.Where you are a consumer and enter into an eligible contract with EXSCI online, or otherwise at a distance, you may cancel that contract without giving a reason within 14 days after the day the contract is entered into, subject to any statutory exceptions. You do not have to give 14 days' notice to use this right. The 14 days run from the day after the contract is formed. If you ask EXSCI to begin the Services during this period, you expressly request that performance begins before the cancellation period has ended. If you then cancel after the Services have begun, you may have to pay an amount proportionate to what has been supplied up to the time you tell us. Where the Services have been fully performed during the cancellation period, following that request and your acknowledgement that the right to cancel will be lost once performance is complete, the statutory right to cancel may no longer apply. This clause does not replace or restrict any statutory rights.
12.3 Withdrawal from a Term Programme. After the statutory cancellation period, you may withdraw a Pupil from a Term Programme by giving at least 14 days' notice In Writing. The Pupil's place remains available during the notice period, and the Pupil may continue attending the scheduled classes. Fees for classes taking place during the notice period remain payable, because the place has been reserved. Where fees have been paid in advance, fees for scheduled classes after the end of the notice period will be refunded. EXSCI will not retain more than is reasonable for losses resulting from the withdrawal, and will take reasonable steps to reduce those losses where it reasonably can. Withdrawal does not affect amounts already due for Services that have already been supplied.
12.4 Individual Lesson packages.Cancellation of an Individual Lesson package is subject to clause 12.2 where that right applies. After any statutory cancellation period has ended, a request to stop an Individual Lesson package is considered against the package purchased, the Services already provided, lessons already reserved, and EXSCI's reasonable losses.
12.5 Refunds. Where a refund is due, EXSCI will process it without undue delay. Where the statutory cancellation rules apply, EXSCI will do so no later than 14 days after being told of the cancellation, where the law requires that. Refunds are normally made to the original payment method, unless we agree otherwise. EXSCI does not charge a fee solely for processing a statutory refund.
12.6 Statutory rights. Nothing in these Terms and Conditions excludes or limits any right or remedy that cannot legally be excluded or limited.
RECORDING OF ONLINE LESSONS
13.1 Where EXSCI records or transcribes an online lesson or class, this may be for educational, safeguarding, quality or administrative purposes. Not every lesson is recorded.
13.2 How recordings and transcripts are collected, used, stored, shared and deleted is set out in the Privacy Policy.
13.3 Pupils and customers must not record or redistribute a lesson themselves without prior permission from EXSCI.
REASONABLE CARE AND SKILL
14.1 EXSCI will provide the Services with reasonable care and skill.
14.2 EXSCI aims to support each Pupil's mathematical development. EXSCI does not guarantee a particular examination result, competition result, school admission, award, grade or other academic outcome.
14.3 Nothing in these Terms and Conditions excludes rights or remedies provided by law.
MODEL CANCELLATION FORM
You may use this form to exercise the statutory cancellation right in clause 12.2. You do not have to use this form. A clear statement In Writing is enough. This form is for that statutory right. It is not the 14 days' notice for leaving a Term Programme under clause 12.3.
